La division jeu vidéo de Vivendi Universal poursuit son ex-associé Interplay Entertainment , l'accusant d'avoir rompu un accord de distribution.

Dans sa plainte déposée auprès de la Cour Supérieure de Los Angeles, VU Games accuse Interplay, contrôlé par l'éditeur français Titus Interactive, d'essayer de rompre l'accord en revendiquant des versements non effectués dans le cadre du dit accord.

Toujours selon cette plainte, Interplay a adressé les 6 et 7 août des courriers à VUG dans lesquels il affirme que c'est ce dernier qui a rompu un accord de distribution remontant à août 2002 en ne procédant pas à certains versements auprès d'Interplay.

VUG affirme avoir rejeté ces accusations par retour de courrier et ajoute que le 16 septembre Interplay lui a envoyé une lettre dans laquelle il met fin purement et simplement à leur accord mutuel. VUG réclame du tribunal la définition exacte des obligations de chaque partie suivant cet accord de distribution, des dommages et intérêts, ainsi qu'un référé interdisant à Interplay de conclure un nouvel accord de distribution avec une autre société

Vivendi Universal's video game arm has sued one-time partner Interplay Entertainment Corp., alleging Interplay breached a distribution deal between the two.
The suit, filed Tuesday in Los Angeles Superior Court, accused Interplay, which is controlled by French publisher Titus Interactive, of trying to get out of a product distribution deal by making claims of unpaid payments under the pact.

An Interplay spokesman was not immediately available for comment.

According to the suit, on Aug. 6 and 7, Interplay sent letters to VU Games claiming VUG was in breach of a distribution agreement between the two from August 2002. Those letters, VUG said, claimed it had withheld payments from Interplay and improperly deducted from a reserve fund.

VUG said it sent letters denying those claims, but on Sept. 16, it said, Interplay sent a letter terminating the agreement.

The suit asks for a determination of each side's obligations under the distribution deal, damages, interest and an injunction preventing Interplay from gaining another distribution deal with a different company.
